This User Agreement (the "Agreement") governs the terms of the use by Client of services offered by A Touch of Classics' FriendlyHost Web Hosting Service("Provider").

Client agrees to receive access to The FriendlyHost services according to the following terms and conditions:

Service Plan. Client agrees to receive services according to the Provider's published service plan. Payment of Services Client will be billed for the days remaining in the month in which service is initiated. Client agrees to pay this amount within 5 days.

Client agrees to pay a minimum of one month in advance for services offered. The payment must be made not later than the 5th of the month for the current months service. If this Agreement is terminated on some day other than the last day of the month, the Client will be Obligated to pay for only the pro rata portion of the monthly service plan charged for the month in which service is terminated.

Term. This agreement may be terminated by the Client or Provider at any time without prior notice and without cause. If either party is in default under this agreement (including nonpayment), then the nondefaulting party may also immediately terminate the Agreement without prior notice to the other party.

Guarantee. We are very confident that you will be satisfied with the services FriendlyHost provides, so we offer a 30-day, money-back guarantee for plans with at least 2 months of service!

File Back-Up. Client is solely responsible for independent backup of data stored on Provider's service. Provider has the right to erase all files upon termination of service.

Content. All services must be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any United States Federal, State or City law is prohibited. This includes but is not limited to: any material which violates or infringes any copyright, trademark, trade secret, patent statutory, common law or or other proprietary rights of others; any material that is libelous or slanderous; any material which is or contains anything obscene or pornographic. distribution lists to be used via unsolicited electronic mail or other mass mailings. Sites that refer to, contain, support or imply "hacker" or "hacker like activity".

Very processor intensive scripts will also incur extra charges.

Billing for Services. E-Mail bills are free. Printed or faxed bills are $3 per billing period for US, Canada, and Mexico. $5 per billing period elsewhere. An annual printed statement is available free of charge.

CNAME for the same 2nd level domain name are free. (example: host.net is the primary domain name then host.com would be a free CNAME.) Other CNAME's are $2.50 per month per CNAME.

Overseas checks must be payable through a correspondent bank which is a member of the federal reserve system.

There is a $20 charge per bounced check.

By default, we make you the billing contact for your domain. If for some reason you want us to be the billing account, you will be charged $80 by us ($70 to InterNic, $10 processing fee).

Content Limitations. NOTE: Pornography and sex-related merchandising are prohibited on all servers. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited.  This is your first and last warning. If you violate this condition your service will be terminated at once!

Other Service Limitations. For security reasons, we don't allow IRC bots or pretty much anything else to do with IRC to run on our systems.

If we get spam complaints against your account, we will charge you $25 per complaint. Excessive spamming can result in account termination. This includes termination of accounts on dedicated servers you are renting from us. Even spamming from a system not on FriendlyHost can cause your account to be terminated as we don't like to harbor spammers. Send spam complaints to abuse@atouchofclasics.com

Please note that due to the large amount of complaints we normally get from just one spam, it is unlikely that you will get a personal reply when you complain about a spammer. But the spammer will be punished.

By default, we filter out spam from known spammers. Let us know if you don't want this filtering done on your account. (We will have to move you to a special machine if you actually want spam mail. Also, if you request spam mail we will assume that you want to be put on the public FriendlyHost "Spam Me" list -- unless we hear otherwise.)

FriendlyHost customers can send copies of spams to filter@atouchofclasics.com and we will consider adding those companies to our filters. Due to the massive spamming on the Internet, do not expect a personal response to such requests.

We store the last two full months of web logs and mail plus the current partial month.

Liability and Warranties Our liability on any account is limited to the amount of money that the customer has paid us. If we incur legal expenses due to a customer, we reserve the right to recover these expenses from the customer. For example, if you have violated a copyright and we are sued (although we shouldn't be as an ISP), we will require you to pay our legal fees.

DISCLAIMER OF WARRANTIES. PROVIDERS SERVICES IS PROVIDED ON AN "AS IS AS AVAILABLE" BASIS. PROVIDER SPECIFICALLY DISCLAIMS ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
